The service

There are four elements to Employment Solutions from Gaby Hardwicke.

1. Document audit

An audit of your employment contracts, handbook, policies and procedures. Where necessary these will be replaced and/or updated with our own bespoke suite of documents. We firmly believe that your documents should not solely be about compliance – they should work for your business by providing maximum flexibility and protection, while making it clear to your staff the standards you expect them to attain.

Changing the terms and conditions of employment is not always straightforward and we will work closely with you and your staff to implement any changes in a positive way.

2. Updating service

It is increasingly difficult for businesses of all sizes to keep up to date with the ever-changing landscape of employment law.

No other area of law has undergone as much change in recent years. This is derived from European directives and regulations, domestic legislation and case law emanating on an almost daily basis from the Court of Appeal and the Employment Appeals Tribunal.

We will not bombard you with daily or weekly updates – but key ones will be available through our social media channels should you want them. You will also receive a comprehensive monthly bulletin of all significant changes in the field of employment law – written in a practical and jargon-free style by our Employment team.

Perhaps more significantly, and we believe uniquely, we will automatically send you updates to your contracts, policies and handbooks where and when they are affected by a change in the law together with step-by-step instructions on how to implement the changes. This means that your documents, following our initial audit, will always be current and compliant, without you having to give them any further thought.

3. Advice service

There are two levels of advice and assistance available to you:

Blue Service

  • You will have unlimited telephone and email access to a specialist employment solicitor during normal business hours, on any aspect of employment law.*
  • Whenever possible this solicitor will be your usual key contact.
  • You will usually get immediate advice but in any event you will be contacted by a member of our team within the hour.

Silver Service

  • You will receive the Blue Service plus assistance with the drafting of documents (such as letters dealing with disciplinary and grievance issues, flexible working requests, performance concerns or redundancy or restructuring procedures).
  • In addition you will be entitled to up to three meetings a year with your key contact. This can be used, for example, to discuss issues of particular concern, to develop a particular strategy, for in-house training or for assistance with the conduct of disciplinary, grievance, performance or even redundancy meetings.

4. Employment tribunal insurance

With Employment Solutions you’ll be automatically insured against the legal costs of defending any employment tribunal claim and any awards made by a tribunal against your business* provided you consult with us and take our advice. You’ll be covered for up to £250,000 per claim (up to £1 million on aggregate for any one year of insurance). Through this cover, supplied by one of the most respected insurers in the legal expenses market, our solicitors will defend you against any employment tribunal claim brought against you and it won’t cost you a penny more – our fees are paid by the insurer.

The average cost of defending an employment tribunal claim is just over £10,000. Tribunal awards for all forms of discrimination and some types of unfair dismissal claims are unlimited and can mean financial ruin for a business.

The insurance policy will also provide your business with cover in the event of a criminal prosecution being brought against it by the Crown Prosecution Service or Health and Safety Executive or for claims under the Data Protection Act 1998.

Some important exclusions

There are some exclusions (*) to the Service such as TUPE advice, collective consultation and trade union recognition, pensions advice, claims for breach of post-termination restrictive covenants and/or directors’ duties but we can offer advice and assistance on all of these issues outside our Employment Solutions service.

Employment Solutions is a cost-effective, fixed-price service suitable for a wide range of businesses. It is not a one-size-fits-all product, as the advice and updating service and insurance premium are tailored for the number of employees on your payroll. You can control the amount you pay by deciding the level of the advice service (blue or silver) or by increasing the amount of any excess under the insurance policy.

It is also kind to your cash flow – the fee and the insurance premium can be paid in 12 monthly interest-free instalments.
